This Agreement between you (“Customer,” “You,” “Your,” “Their”) and Continental Divide Electric Cooperative, Inc.(“CDEC,” “Service Provider,” “Us,” “Our,” “We”) is applicable to CDEC's Red Bolt Broadband service (“Service”).
1. SERVICE CHARACTERISTICS:
- The term of this Agreement is one (1) year, beginning with the Service installation date and will continue until the Customer terminates Service. The term of this agreement automatically renew for one (1) year unless Customer contacts Service Provider at least thirty (30) days prior to term end date to terminate services or opt into monthly terms. If Customer chooses to discontinue Service, CDEC requires a thirty (30) day notice. Customer’s thirty
(30) day notice will become effective beginning on the date that the next monthly payment is due.
- Standard activation fee, all monthly service fees, and any other amounts owed hereunder, together with any corresponding taxes and/or reimbursement charges as described, are not deposits and are non-refundable.
- Standard installation includes 100 feet of CAT6 cable on the outside of the building and 10 feet inside from the point of entry. Customer represents there are no legal, contractual or similar restrictions on the installation of the CDEC equipment in location(s) authorized.
- Unless otherwise agreed to in writing, Customer’s right to use Service, or to designate other users of the account, IS NOT TRANSFERABLE and is subject to any limits established by this Agreement, or by Customer’s credit card company or other billing institution, as applicable.
2. REDISTRIBUTION OF SERVICE:
Customer agrees not to sell or redeliver Red Bolt Broadband Service without the express written consent of CDEC, including, but not limited to, sharing an access point for multiple locations using wires or wireless technology and charging other residents or businesses to access Service from outside Service address.
3. PAYMENT AND BILLING:
- You agree that CDEC will bill your monthly Service fee in advance, via monthly paper statement by mail, or paperless notice via email. Initial billing period shall begin when Service is available for use.
- You will be charged any applicable taxes and/or franchise fees.
- Payment of the outstanding balance is due in full by the 20th day of each month. If payment is not received before the next statement is issued, you will be assessed a $5.00 late fee, plus tax, and will be disconnected within five (5) business days. To reconnect, you must pay your total bill and a reactivation fee of $25.00 plus tax, within seven (7) days of disconnection. After seven (7) days of disconnection, the reactivation fee is $50.00 plus tax.
- We reserve the right to suspend Service or terminate this Agreement without notice, if payment is not received before the next statement is issued. If CDEC uses a collection agency or attorney to collect money owed, or to assert any other right that CDEC may have, you agree to pay the reasonable costs of collection or other action, including, but not limited to, collection agency costs, reasonable attorney fees, and any court costs.
- You are required to provide us complete and accurate information for your billing account, and promptly update any changes (including to your email and billing addresses, credit/debit card number and expiration date). If we are unable to process your credit or debit card at any time, your account may be immediately suspended or terminated, and you will remain responsible for all amounts payable by you to CDEC.
4. CONTINUITY OF SERVICE:
- All small commercial plans include best-effort symmetrical speeds and bandwidth, and customer support between 8:00 a.m. and 5:00 p.m. on weekdays. Report connection issues or outages by telephone at 505-876-2020 or by email at redboltsupport@cdec.coop. A technician will assist with diagnosing the issue and restoring connectivity of Service. - CDEC is not responsible for supporting network equipment or peripheral equipment, including, but not limited to PCs, MACs, software applications, other carrier’s equipment and routers not provided by CDEC. If Customer utilizes a CDEC router, internet speeds are tested at the router inside the premises. If Customer provides their router, internet speeds are tested at the optical network terminal outside the premises. Neither Service quality or tech support is guaranteed or provided beyond testing point.
5. RENTAL EQUIPMENT:
If you rent our equipment (i.e., router or Wi-Fi extender) and return it upon cancellation of Service or any reason other than device malfunction, and the equipment needs cleaning, you will be charged a $20.00 cleaning fee plus tax, per device. If a device is returned unusable, you will be charged the equipment's full retail value.
6. TERMS OF SERVICE:
Customer acknowledges receipt of Terms and Conditions of Service, which are incorporated by reference as though fully set forth herein, and Customer agrees to be bound by them.
